This Katalyst Data Management LP (“Katalyst”) Privacy Policy (the “Privacy Policy”) describes how Katalyst and its affiliates (collectively, “Katalyst”, “we”, “us”, or “our”) collects and uses information about you when you access and use the Katalyst website, www.katalystdm.com (the “Site”), and/or any tools, features or services associated with, arising from or related to www.seismiczone.com, Katalyst’s proprietary platform (“SeismicZone”, and together with the foregoing website and related tools, features and services, collectively, the “Site”). By accessing or using SeismicZone and/or the Site, whether directly or indirectly, you agree to accept and adhere to the practices, terms and conditions described in this Privacy Policy. What information do we collect? 

When ordering, registering or using certain features on our Site and/or specifically through SeismicZone, as appropriate, you may be asked to enter your name, email address and other information necessary for you to register or to fill out certain forms. You may, however, visit our Site anonymously, but you may be restricted from accessing certain pages, features and tools, including without limitation, SeismicZone. This Privacy Policy applies only to information collected through our Site and/or SeismicZone, and not to information collected offline.
In addition, if and when you use a mobile device (i.e., mobile phones, tablets, etc.) to access the Site or any features, tools or services thereon, we reserve the right to collect your unique device identifier, IP address and your location.

What do we use your information for? 

Any of the information we collect from you may be used in one of the following ways:

  • To personalize your Site / SeismicZone experience (your information helps us to better respond to your individual needs)
  • To improve our Site (we continuously strive to improve our website offerings based on the information and feedback we receive from you)

Do we use cookies? 

We use session cookies, web beacons and similar technologies, to help us improve your katalystdm.com experience, increase security, and measure use of our Site and its related applications, platforms and services. Do we disclose any information to outside parties? 

We do not sell, trade, lease or otherwise transfer your personally identifiable information to outside parties. We use trusted third parties who assist us in operating our Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe such a release is appropriate to comply with the law, enforce our Site policies, or protect ours or others rights, property or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

We also reserve the right to transfer your user information in the event we sell or transfer all or a portion of our business or assets. Occasionally, at our discretion, we may include or offer third party products or services on our Site. These third party sites have separate and independent privacy policies. We, therefore, neither have any responsibility or liability, nor guaranty any security related to the content and activities or these linked sites. Nonetheless, we seek to protect the integrity of our Site and welcome any feedback about these other sites

No Use by Children 

Our Site is not intended for use by persons under the age of eighteen (18). We will never knowingly collect information directly from users under that age, and we expressly request that users under the age of 18 do not provide us with information of any kind whatsoever. If we become aware that a user is under the age of eighteen (18) and has submitted information of any kind to us, we will remove his or her information from our files. We understand that children may not fully understand all of the provisions of this Privacy Policy or make informed decisions about when and with whom they share personal information. We encourage parents and guardians to spend time with their children online and to be familiar with the websites they visit.

Social Media 

If you access any aspect of our Site through Facebook, Twitter or any other social media tool, application or site, including without limitation, SeismicZone, then you will have a separate, additional account relationship with that social media provider. By way of example, your use of Facebook in general and your relationship with Facebook are subject to Facebook’s own privacy policy and Facebook’s other terms and policies, which we strongly recommend that you review those before you access any aspect of our Site through Facebook. We do not control and are not responsible for a social media provider’s processing of your information.

Right to Request

Upon verifiable request, we will take the necessary steps to disclose and deliver, free of charge to the consumer, the personal information we hold on the consumer, which may be delivered by mail or electronically.

Right to Know

The consumer has the right to request that a business that collects personal information disclose the following: (1) the categories of personal information collected; (2) the sources from which the information was collected; (3) the business or commercial purpose for collecting or selling the information; (4) categories of third parties with whom the business shares the information; (5) the specific pieces of personal information the business collected about the consumer.

Right to Delete

The consumer has the right to request, upon verifiable request, that we delete any personal information about the consumer we have collected. Upon receipt of such request, we will delete the information and direct any service providers to delete the information from its records as well unless we or our service provider needs the information to: (1) compute the transaction for which the personal information was collected, provide a good or service requested by the consumer, or reasonably anticipated within the context of a business’s ongoing business relationship with the consumer, or otherwise perform a contract between the business and the consumer; (2) detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; (3) debug to identify and repair errors existing intended functionality; (4) exercise free speech, ensure the right of another consumer to exercise his/her right of free speech, or exercise another right provided for by law; (5) comply with the California Electronic Communications Privacy Act; (6) engage in public or peer-received scientific, historical, or statistical research in the public interest; (7) to enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with the business; (8) comply with a legal obligation; (9) otherwise use the consumer’s personal information, internally, in a lawful manner that is compatible with the context in which the consumer provided the information.

Right to Opt Out

The consumer has the right to opt out of the sale of personal information. As stated above, we do not sell, trade, lease or otherwise transfer your personally identifiable information.

Data Privacy

Katalyst holds all client data under strict confidentiality rules and takes appropriate and reasonable steps to safeguard that confidentiality. Katalyst does not release the names of its clients other than where permission to do so has been explicitly granted. Katalyst does not release any information on client data holdings or data activity.

Changes to our Privacy Policy 

We will occasionally update this Privacy Policy to reflect changes in our practices and services. You must cancel your account and cease all use of our Site (including without limitation, use of SeismicZone) if you no longer agree with the provisions set forth hereunder, but if you choose to do so, any information you provided to us prior to the cancellation of your account will be subject to the terms of the Privacy Policy that were in effect at the time this information was provided to us.
